First Nation Safety Officer (FNSO) Program
On August 12, 2024, Waywayseecappo First Nation and the Provincial Minister of Justice entered into a First Nation Safety Officer Program Operating Agreement. This agreement, effective until March 31, 2025, establishes a team of four full-time and three part-time First Nation Safety Officers who operate around the clock to uphold safety within our community.
Mandate and Authority
Under this agreement, the FNSO program grants Safety Officers designated peace officer authority, as specified by the Police Services Act. This mandate allows Safety Officers to carry the “powers, duties, privileges, and protections” of a Peace Officer, at common law and under the Operating Agreement between the Province of Manitoba and Waywayseecappo First Nation.
Safety Officers are empowered to enforce various acts essential to community well-being, including:
- The Highway Traffic Act
- Waywayseecappo First Nation By-Laws
- Liquor, Gaming, and Cannabis Control Act
- The Smoking and Vapours Products Control Act
- Intoxicated Persons Detention Act
- Minors Intoxicating Substances Control Act
- The Public Health Act
- The Mental Health Act
- The Trespass Act
- The Child and Family Services Act
- Arrests (e.g., breach of peace)
- Search and Seizures
Focus and Community Support
FNSOs prioritize public safety and crime prevention. While on duty, they also assist community members by offering victim services referrals and social services contacts. At times, Safety Officers may assist the Manitoba First Nations Police Service or RCMP with non-criminal matters, though they do not handle Criminal Code investigations.
Complaint Process
If a community member wishes to file a complaint against a Safety Officer, there are two pathways:
- Criminal Matters: Contact the Manitoba First Nations Police Service.
- Non-Criminal Matters: Complaints can be directed to Waywayseecappo First Nation Chief and Council, who follow an established review protocol.
